Article 1 | General
1.1 These general terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with VINVIN B.V. (VINVIN), hereinafter referred to as “VINVIN”, “us” or “we”, via the VINVIN website, the mobile website or a mobile device (collectively referred to as https://vinvinwines.nl).
1.2 By using www.winwinwines.nl and/or placing an order, you accept that you are bound by the following terms and conditions (the “Terms and Conditions”). Please make sure you have read and understood the Terms and Conditions before placing your order.
1.3 Only persons of 18 years of age or older, who are not under guardianship, can place an order.
1.4 The fact that products or services are offered on www.vinvinwines.nl , offers no guarantee that these products or services are available at all times. We reserve the right to withdraw products at any time.
1.5 The version of the Terms and Conditions applicable to your order is the version available on VINVIN’s website at the time of placing your order.

Article 2 | Agreement, order and delivery costs
2.1 This agreement is binding, once you have placed an order. Once your order has been placed, VINVIN will process your order. You will receive an automatic order confirmation by e-mail and will be sent to the e-mail address you have provided. Even if you do not receive an e-mail, your order will still be valid.
2.2 The prices mentioned on www.vinvinwines.nl are in Euro (€) and include the legal VAT. Each price is valid as soon as it is mentioned on the website. Possible price adjustments only apply after your order has been placed.
2.3 All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typesetting errors.
2.4 VINVIN charges various delivery costs.
After we have received your payment, we strive to deliver your order within 48 hours (provided the ordered products are in stock).
For orders under €200.00, we charge a contribution to the shipping costs of €7.50 per order. On the other hand, you can compose your order however you like and there is no obligation to deliver up to 6 bottles per type. We would be happy to advise you on this.
Only when VINVIN B.V. has made errors in the delivery, a right of return can – if reported within 2 working days – be invoked.
2.5 Prices in shops and online may vary.
2.6 If you have registered your e-mail address, you will receive a confirmation by e-mail after placing an order. If we are unexpectedly unable to deliver your order, we will let you know as soon as possible. If the order has already been paid for, we will try to refund the payment via the payment method used by you. If the refund has to be made in another way, VINVIN will contact you to arrange this.
2.7 An order must be at least €1.00 (after deduction of discounts).
Article 3 | Delivery
3.1 VINVIN takes great care in the registration and processing of orders and strives to deliver your order to an address in the Netherlands, in accordance with your chosen method of delivery.
3.2 If VINVIN has to deliver the order within the Netherlands, VINVIN shall endeavour to ship it within 48 hours after receipt of payment. The products will be delivered within 1 to 3 days after your payment has been received by us. If this is not possible (for example, because your order is temporarily out of stock) or an order can only be partially packed, you will be informed by VINVIN within 48 (forty-eight) hours at the time the order is placed. In this case you have the right to cancel your order, without any additional costs.
3.3 VINVIN aims to ship your order within 24 hours after receipt of payment. Although we strive to deliver within the set time limit, delays may occur due to unexpected events.
3.4 Delivery will take place as long as stocks last.
3.5 The place of delivery shall be the address given by you to VINVIN.
3.6 If you have given VINVIN the wrong delivery address, you will pay the extra costs for delivery yourself.
3.7 You are obliged to take delivery of the purchased products at the time they are made available to you.
3.8 All deadlines mentioned on the website are indicative. No rights can therefore be derived from the periods mentioned.
Article 4 | Returning
4.1 You have the right to return (a part of) the delivered goods within a period of 14 (fourteen) days from the moment of delivery, without giving a reason:
In the unlikely event that there are products of VINVIN B.V. which do not meet your expectations, you may report your complaints at the latest 2 weeks after delivery via firstname.lastname@example.org. We will deal with your complaint immediately and strive for a good solution.

4.2 You may dissolve the agreement or return the articles. You must inform VINVIN within 14 (fourteen) days by contacting email@example.com. After VINVIN’s written consent, you will receive an e-mail indicating the possibility of return.
Upon receipt, the goods must be checked immediately for any defects or damage/breakage. Any problems must be reported immediately to the carrier. Complaints must also be reported to VINVIN B.V. by e-mail within 24 hours after receipt of your order. After 24 hours we will no longer be responsible for any complaints.
As we deal in perishable goods it is only possible to cancel an order before it has been dispatched. Payments already made will then be refunded immediately.
The transport costs of the return to VINVIN shall be at your expense – this shall not be the case if the fault lies with VINVIN.
4.3 If you have not returned the delivered goods to VINVIN at the end of this period (14 days), the sale is a fact.
Article 5 | Shipment & Transport
5.1 During transport of the products, VINVIN shall bear the risk in case of damage, theft or loss of the products. The risk shall pass to you at the time of delivery.
5.2 VINVIN sends parcels via the parcel post service of MyParcel.
Article 6 | Payment methods
6.1 On the VINVIN website, you can choose from the following secure payment methods: IDEAL, credit card (VISA, Mastercard and AMEX), PayPal, Apple Pay, SOFORT banking, Bancontact
6.2 Payments with IDEAL are made via a secure Mollie connection. Mollie is one of the most reliable platforms in The Netherlands.
6.3 You can pay with your credit card. Credit card payments are also made via a secure Mollie connection.
6.4 VINVIN remains the full owner of all products delivered, until the purchase price and any other amounts due have been paid in full.
Article 7 | Liability
7.1 VINVIN’s liability for direct or indirect damage caused by a product purchased from VINVIN shall in any case be limited to an amount equal to the selling price of the product, unless there is intent or gross negligence on the part of VINVIN. Our maximum liability towards you for losses or damage caused by your order on www.vinvinwines.nl is limited to the total amount of your order.
7.2 VINVIN shall not be responsible for indirect losses which are an incidental effect of the original loss or damage, such as loss of profit or loss of opportunity, or non-delivery of goods or failure to comply with any other obligation under these Terms and Conditions, if such failure is the result of events beyond our control, including, but not limited to, fire, flood, storm, insurrection, political unrest, war, atomic accidents and terrorist activities.
7.3 Our maximum liability to you for losses or damages arising from your order on www.vinvinwines.nl is limited to the total amount of your order.
7.4 All images; photographs, videos etc.; data concerning weights, dimensions, colours etc. on VINVIN’s website are approximate only, are indicative and cannot give rise to compensation or dissolution of the agreement.
Article 8 | Force majeure
8.1 For the purpose of this Article, force majeure shall mean: all shortcomings which VINVIN cannot be held accountable for or is unable to limit or exclude under the law.
8.2 In case of force majeure preventing VINVIN from fulfilling its obligations, the obligations shall be suspended for a duration of the force majeure situation. After 30 (thirty) days, both parties have the right to dissolve the agreement in whole or in part by means of a written statement, without being entitled to any (damages) compensation.
Article 9 | Guarantee
9.1 We treat our wines with the utmost care when they are purchased, stored and shipped. However, we cannot guarantee the quality of the wines delivered in terms of taste, cork, etc.
9.2 You are obliged to check the delivered goods immediately upon receipt. If it appears that the delivered goods are wrong or incomplete, you must (before returning them to VINVIN) immediately report these defects to VINVIN by e-mail. Any defects or incorrectly delivered goods must and can be reported to VINVIN by e-mail at the latest 7 days after delivery.
9.3 Taking into use after detection of default, damage caused after detection of default, encumbrance and/or resale after detection of default, this right to complain and return lapses entirely.
9.4 This guarantee shall not apply if, 1) the buyer is in default towards VINVIN, 2) the delivered goods have been exposed to abnormal circumstances or are otherwise handled carelessly or contrary to VINVIN’s instructions.
9.5 After expiry of the guarantee period referred to in Article 4.1, VINVIN is entitled to charge all replacement costs, including administration, shipping and call-out charges.
Article 10 | Privacy & Data Management
10.1 If you place an order with VINVIN, your data will be included in VINVIN’s customer database. In accordance with the Data Protection Act your data will not be provided to third parties.
10.2 VINVIN respects the privacy of the users of the website and ensures the confidentiality of your personal data.
10.3 If you have registered for this, VINVIN may use a mailing list. Each mailing contains instructions on how to remove yourself from this list.
Article 11 | Property Rights
11.1 All intellectual property rights, such as trademarks and copyrights on www.vinvinwines.nl are vested in VINVIN B.V.
11.2 Any use of www.vinvinwines.nl or its content, including the total or partial copying or storage of such content other than for your own, personal and non-commercial use is prohibited without the prior written consent of VINVIN.
Article 12| Transfer
12.1 VINVIN reserves the right to assign or transfer to a third party any claims for payment (including any terms of payment) in connection with the delivery of goods.
Article 13 | Severability
13.1 If any part of these Terms and Conditions is held invalid or declared null and void by any court or legislature, the remaining Terms and Conditions shall remain in force.
Article 14 | Applicable law
14.1 All legal relationships to which VINVIN is a party shall be governed exclusively by Dutch law, even if an obligation is performed wholly or partly abroad or if the party involved in the legal relationship is domiciled there.
14.2 Disputes arising from an agreement between VINVIN and the Buyer, which cannot be resolved by mutual agreement, shall be heard by the competent court within the district of Rotterdam, unless VINVIN prefers to submit the difference to the competent court of the Buyer’s domicile, with the exception of those disputes which fall within the jurisdiction of the subdistrict court.
